Distance Sales Agreement

This Distance Sales Agreement governs the remote sale of a FelixMail electronic email service subscription between the Seller identified below and the Buyer, in line with applicable Turkish consumer-protection law.
1. Parties & Seller information
Seller: Mıktad Tahir Durak - felixart (sole proprietorship) · Address: Gülük Mahallesi Sevinç Sk. 10/27 · Tax office / no: Mimarsinan / 3150604983 · Email: info@felixmail.email. Buyer: the business/user purchasing the service and registered in the panel.
2. Subject
The subject is the provision of a custom-domain business email subscription purchased electronically via FelixMail, and the parties' rights and obligations.
3. Service & pricing
The service is offered as a monthly subscription per active mailbox. Current plans and prices are shown on the checkout screen, taxes included. The amount you confirm at checkout applies.
4. Payment
Payments are collected by credit/debit card through our payment provider's (iyzico) secure, PCI-DSS compliant virtual POS.
5. Card storage & recurring payment
At the start of the subscription your card is securely stored at the payment provider for future charges; a ₺1 verification transaction is performed to validate the card and is refunded/voided immediately. You expressly authorize the monthly subscription fee to be charged automatically to your stored card at the start of each billing period (recurring payment) until you cancel. Your full card number is not stored by the Seller; the card is stored only at the payment provider and represented by a token. You can stop automatic charges at any time by cancelling from the panel.
6. Delivery (performance)
The service is electronic and requires no physical delivery. Upon payment confirmation, the service is activated immediately via the panel. Activation and setup steps are sent to the Buyer by email and panel notification.
7. Right of withdrawal
For services performed immediately and electronically with the Buyer's consent, the right of withdrawal generally does not apply. You may nevertheless cancel your subscription at any time; our Refund & Cancellation Policy applies.
8. Cancellation & refund
You can cancel anytime from the panel; cancellation stops the next period's automatic charge. Service stays active until the end of the current billing period and does not renew afterwards. If you cancel during the 14-day free trial, no charge is made. For incorrect or duplicate charges, contact us within 14 days; eligible requests are refunded. See the Refund & Cancellation Policy.
9. Suspension for non-payment
If the subscription fee cannot be collected, the Seller notifies the Buyer by email and retries the payment several times. If payment still cannot be collected, the service is restricted in the following stages: (a) Access to mailboxes is suspended; at this stage emails sent to the Buyer CONTINUE to be accepted and stored in the mailbox and are not deleted. (b) 60 days after suspension, acceptance of new email also stops; messages sent after that date are returned to the sender. Existing emails are still not deleted. (c) 180 days after suspension, a final warning is sent to the Buyer stating that the mailbox will be deleted. (d) If payment is not made within 30 days from the date of that warning, the mailbox and all data within it are PERMANENTLY DELETED; this action is irreversible. If payment is completed at any stage, the service and all emails stored up to that point become fully accessible again.
10. Data export
Even after the subscription has ended, the Buyer may request a copy of their email archive by contacting the Seller before the mailbox's permanent deletion date. Requests are fulfilled within a reasonable period subject to identity verification. Once deletion has occurred, recovery of the data is technically impossible.
11. Privacy & data
Your personal data is processed under our Privacy Policy and applicable law. Payment data is processed by the payment provider.
12. Disputes
The Buyer may submit complaints to the Seller. Consumer Arbitration Committees and Consumer Courts at the Buyer's place of residence have jurisdiction within the monetary limits set by law.
13. Effect
By approving this agreement at checkout, the Buyer accepts all terms and the agreement is concluded electronically.
